Regulatory Law

Many professionals are regulated by an official body which set the standards that must be adhered to within the profession and then monitor compliance. Often the regulation of members’ behaviour will extend beyond the workplace and usual working hours.

Example professions and their regulatory bodies:

  • Barristers – Bar Council
  • Doctors – General Medical Council
  • Dentists – General Dental Council
  • Pharmacists – General Pharmaceutical Council
  • Nurses and Midwives – Nursing and Midwifery Council
  • Independent Financial Advisors – Financial Conduct Authority
  • Teachers – Teaching Regulation Agency
  • Care Homes – Care Quality Commission (CQC)
  • Pension Advisors / Trustees – The Pensions Regulator (TPR)
  • Professional Footballers – Football Association (FA)
  • Health and Safety Executive (HSE)

Where it is alleged that a professional’s conduct amounts to a breach, the professional body will undertake an investigation and may instigate disciplinary proceedings if deemed necessary. A breach may be an allegation of incompetency or relate to inappropriate or unlawful activities. In the most serious disciplinary cases the professional body may revoke the registration or license of the professional so that they are no longer able to practice.
